This version adds that to Β§4, notes the gym-link deletion in Β§11, and adds Google (Google Maps Platform) to the providers in Β§10. The Privacy Policy gains a location section and a Google provider row.


1. Status of these terms

Fyvorin is beta software. It is provided for evaluation, is under active development, and may change substantially or be discontinued. These terms are provisional and will be replaced by launch terms.

2. Who we are

Fyvorin is operated by Cypher Systems Group. For any questions regarding these Terms or the Beta Software License, contact fyvorin-support@cyphersystemsapps.com.

3. Eligibility

4. What Fyvorin does

Fyvorin is a fitness and nutrition application. It helps you:

5. AI-generated content is not medical advice

This is the most important section.

You are responsible for judging whether any suggestion is appropriate for you.

6. Health and safety

Physical exercise and dietary change carry inherent risk. You use Fyvorin at your own risk. You are responsible for exercising within your own limits and for the accuracy of the information you enter; the quality of AI output depends on it.

7. Your account

You sign in with an email address and password, or with your Google account. You are responsible for keeping your credentials secure and for activity under your account. Tell us promptly at fyvorin-support@cyphersystemsapps.com if you believe your account has been compromised.

9. Your data

Our Privacy Policy describes what we collect, where it is stored, which third parties process it, and how to delete it. In summary: your health and profile data is stored on Google Cloud (Cloud Run and Cloud SQL, us-central1), and is used to generate plans and coaching, which involves sending relevant context to third-party AI and data providers. If you use gym search, your approximate location is sent to our backend and to Google Maps Platform to find nearby gyms, is not stored, and only the gym you select is recorded.

10. Third-party services

Fyvorin relies on third-party services, including DeepSeek (AI generation), Spoonacular and TheMealDB (recipe and ingredient data), ElevenLabs (coach voice synthesis), RapidAPI providers (exercise catalogue, muscle imagery) and β€” for gym search only β€” Google (Google Maps Platform) (place lookup). Their availability and behaviour are outside our control. Your use of derived output may also be subject to their terms. [COUNSEL: confirm whether any provider requires us to flow down specific terms to end users, and in particular whether Google Maps Platform requires specific end-user attribution or terms.]

11. Deleting your account

You may delete your account and all associated data at any time:

Deletion is permanent and immediate from all live systems. It removes your profile, workouts, nutrition logs, body metrics, goals, chat history, AI memories, your Training Environments (including each linked gym's identifier and its name/address display copy), your identity mapping and your authentication record. There is no soft-delete or recycle bin, and account deletion cannot be undone. Standard operational database backups (maintained solely for disaster recovery) retain copies for a bounded retention period before aging out automatically; these are not accessible through the service and are not used to restore individual deleted accounts.

12. Availability and changes

The beta may be unavailable, may lose data, and may change without notice. We do not promise any particular uptime or that any feature will continue to exist. We may modify or discontinue the beta at any time.

If these terms change in a way that requires your agreement, the app will ask you to accept the new version before you can continue using it. Acceptance is recorded against a version, so a revised document is always re-presented rather than silently applied.

13. Intellectual property

We and our licensors own Fyvorin, its software, design and content. You keep ownership of the content you submit (for example, notes and chat messages) and grant us the licence needed to operate the service. Gym information shown in the app is provided by Google and is subject to Google's terms. [COUNSEL: confirm the exact licence wording you require.]

14. Disclaimers

To the maximum extent permitted by law, Fyvorin is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, secure or error-free, or that AI output will be accurate or suitable.

15. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for any loss of data, profits or goodwill, arising from your use of the beta. [COUNSEL: insert a liability cap and confirm enforceability in your jurisdiction.]

Open legal questions (flagged, not guessed)

These are points where I cannot determine the legally sufficient answer and am deliberately not inventing one.

  1. No age gate. The app collects age but does not verify it or block minors. This is a significant issue if the service is reachable by children.
  2. Health data is special-category. Under GDPR Art. 9 (and similar regimes) health data needs an explicit legal basis and explicit consent. Mexican law treats datos personales sensibles similarly, requiring express written consent. Whether the current single checkbox is sufficient is a legal question.
  3. Retention. The code implements no retention policy or automatic deletion. Data persists until the user deletes the account. If a retention period is required or desirable, it must be designed and implemented β€” I did not invent one.
  4. AI provider terms. I cannot verify DeepSeek's, Spoonacular's, ElevenLabs', the RapidAPI providers' or Google's current data-use and retention policies, or whether they train on submitted data. That affects what we can honestly promise in the Privacy Policy.
  5. International transfers. Data is processed in us-central1 (United States). If users are in Mexico or the EU, transfer mechanisms may be required.
  6. Arbitration / class-action waiver. Not included. Jurisdiction-dependent; decision for counsel.
  7. Location and Google Maps Platform (new in Beta 1.1). [COUNSEL / UNVERIFIED: confirm that a transient, never-stored server-side passthrough of approximate location is correctly declared on Play's Data Safety form, that the in-app pre-prompt plus the Android permission satisfy the prominent-disclosure requirement, and that the gym-identifier-plus-bounded-display-copy storage model and the "Google Maps" attribution presentation satisfy the current Maps Service Specific Terms.]
